Terms of sale

I'll create a dedicated Terms and Conditions of Sale for SeeMyMailsMarketplace, using the SeeMyMails legal-policy structure we've previously discussed, but adapting it to your Shopify dropshipping business.

This version will cover physical products, third-party suppliers, international shipping, payments in euros, cancellations, returns, refunds, EU consumer rights, warranties and customer complaints.

The document will be in English and ready to adapt for your Shopify Terms of Service policy page. Since your business registration details and fulfillment arrangements are not fully verified, I'll clearly identify the information that must be completed before publication.

TERMS AND CONDITIONS OF SALE

SeeMyMailsMarketplace

Effective Date: October 20, 2026
Website: https://seemymailstiktokvirals.myshopify.com
Trading Name: SeeMyMailsMarketplace

1. Introduction

Welcome to SeeMyMailsMarketplace.

These Terms and Conditions of Sale (“Terms”) govern purchases made through SeeMyMailsMarketplace (“Marketplace,” “we,” “us,” or “our”).

Our online marketplace offers a variety of products, including electronics, mobile accessories, fashion, beauty products, home and lifestyle items, gadgets, and other consumer merchandise.

Some products are sourced, stocked, packaged, or shipped by independent suppliers through dropshipping and third-party fulfillment arrangements.

By placing an order, customers agree to these Terms, subject to applicable mandatory consumer protection laws.

2. Seller Information

Trading Name: SeeMyMailsMarketplace
Legal Seller: [Confirmed legal entity or registered individual]
Registered Address: [Confirmed business address]
Business Registration Number: [If applicable]
VAT Registration Number: [If applicable]
Customer Support: [Confirmed support email]
Website: https://seemymailstiktokvirals.myshopify.com

SeeMyMailsMarketplace is associated with the SeeMyMails brand. However, the legally responsible seller is the entity or individual identified above and on the customer's order confirmation.

3. Products and Availability

We aim to provide accurate product descriptions, specifications, photographs, prices, and availability information.

Product images are provided for illustration purposes. Minor differences in packaging, appearance, or color may occur.

Product availability may change due to supplier inventory levels, manufacturing schedules, or logistical circumstances.

Where a product becomes unavailable after an order has been accepted, we will inform the customer and provide an appropriate remedy, including a refund where required.

We reserve the right to correct obvious listing errors, subject to applicable law and the customer's rights.

4. Orders and Contract Formation

Customers place orders by selecting products, reviewing their shopping cart, providing delivery information, and completing the checkout process.

Before submitting an order, customers will have an opportunity to review the essential details, including products, quantities, prices, delivery charges, and the total payable.

The checkout process will clearly indicate when the customer is placing an order with an obligation to pay.

An automated order acknowledgment confirms receipt of the order but does not necessarily constitute final acceptance.

A sales contract is formed when we expressly accept the order, subject to applicable consumer laws.

We may reject an order for legitimate reasons, including payment failure, unavailability, suspected fraud, or restrictions on shipping particular products. Any payment collected for a rejected order will be refunded.

5. Pricing and Currency

The Marketplace's base currency is the euro (EUR).

Prices may be displayed in other currencies depending on the customer's location and the payment or currency-conversion features supported by Shopify.

The final payable amount, including applicable taxes and delivery charges, will be displayed before the customer confirms payment.

Where legally required, consumer-facing prices include applicable VAT.

Currency conversion rates may vary according to the payment provider or issuing bank. Any additional bank conversion fees imposed by the customer's provider are outside our control.

Promotional prices, discounts, and special offers are valid only under their stated conditions and availability.

6. Payments

Payments are processed through the payment methods displayed at checkout.

Available methods may include bank cards, digital wallets, or other supported payment services.

Payment information is processed by the applicable payment providers in accordance with their security and privacy arrangements.

Orders may be subject to automated fraud-prevention and payment-verification procedures.

Customers must provide accurate billing and payment information and be authorized to use the selected payment method.

7. Dropshipping and Third-Party Suppliers

SeeMyMailsMarketplace may work with independent suppliers, manufacturers, distributors, and fulfillment providers.

Depending on the product, an order may be shipped directly from a supplier's warehouse to the customer.

Products purchased together may arrive in separate packages.

Where SeeMyMailsMarketplace is the seller of record, the use of third-party suppliers does not remove our legal responsibilities toward the customer.

Customers should contact SeeMyMailsMarketplace for order-related complaints, returns, refunds, and statutory warranty claims rather than being required to resolve those matters directly with the supplier.

8. Shipping and Delivery

We may offer delivery to France, other European countries, and additional international destinations as made available at checkout.

Shipping costs, available methods, and estimated delivery periods will be presented before order confirmation.

Delivery times may vary according to the supplier's location, destination country, shipping method, customs procedures, and carrier operations.

Any delivery estimate is not a guarantee unless expressly stated as a binding delivery commitment.

We will fulfill orders within the agreed delivery period. Where no delivery date or period has been agreed, applicable statutory delivery deadlines will apply, including the default 30-day rule for relevant EU consumer sales.

If an order is not delivered within the legally required period, customers may exercise their applicable rights to request delivery, cancel the contract, and obtain a refund.

Risk of loss or damage generally transfers to a consumer when the consumer, or a third party designated by them other than the carrier, takes physical possession of the goods, subject to applicable legal exceptions.

9. Customs Duties and Import Charges

International orders may be subject to customs declarations, import VAT, customs duties, or other government charges.

Where such charges are included in the checkout price, this will be indicated.

Where additional import charges may be payable by the customer, this information will be disclosed before the order is placed, as required by law.

Customers are responsible only for charges lawfully allocated to them and properly disclosed.

10. Right of Withdrawal — EU Consumers

Consumers purchasing eligible goods online within the European Union generally have a legal right to withdraw from the purchase within 14 calendar days after receiving the goods, without providing a reason.

For orders delivered in multiple packages, the withdrawal period generally begins upon receipt of the last item or package, where applicable.

To exercise this right, customers must notify us through an unequivocal statement, such as an email, before the withdrawal period expires.

Customers may use the statutory model withdrawal form where applicable, but are not required to use that form.

After notifying us of withdrawal, customers generally have a further 14 days to return the goods.

We will refund the payments required by law, including eligible standard outbound delivery costs, within the statutory period. We may withhold reimbursement until the returned goods are received or evidence of their dispatch is supplied, where permitted by law.

Customers may be responsible for direct return shipping costs only where this was properly disclosed before purchase.

Exceptions to the withdrawal right may apply to certain categories of products, such as qualifying personalized goods, sealed hygiene products that have been unsealed after delivery, and other statutory exceptions.

We will not apply an exception unless the legal conditions for that exception are satisfied.

11. Returns and Refunds

Customers may request a return or refund for eligible purchases by contacting customer support.

Return requests should include the order number, relevant product details, and the reason for the request where relevant.

For defective, damaged, incorrect, or nonconforming goods, customers retain their statutory remedies, regardless of any discretionary return policy.

Where a return is authorized, we will provide appropriate return instructions and the relevant return address.

Customers should not send products to an unverified supplier address.

Refunds will normally be made using the original payment method unless another arrangement is expressly agreed and legally permitted.

Any voluntary return period beyond the statutory withdrawal period will be specified separately in our published Refund and Return Policy.

Nothing in these Terms limits the customer's mandatory rights under applicable consumer legislation.

12. Damaged, Defective, or Incorrect Products

If a customer receives an incorrect, damaged, or defective product, they should contact customer support as soon as reasonably possible.

We may request photographs or other reasonable information to assess the issue. Such requests do not remove or restrict statutory consumer rights.

Depending on the circumstances and applicable law, customers may be entitled to repair, replacement, a price reduction, or a refund.

Where the seller is responsible for nonconforming goods, the customer will not be required to bear costs that applicable law places on the seller.

13. Legal Guarantees

Consumers benefit from mandatory statutory guarantees and remedies under applicable national law.

For sales governed by French consumer law, this includes the garantie légale de conformité and the applicable warranty against hidden defects.

The French legal guarantee of conformity generally applies for two years from delivery of goods, subject to the detailed statutory rules.

Any commercial or manufacturer warranty is additional to, and does not replace, mandatory legal guarantees.

14. Product Safety and Compliance

We aim to offer products that comply with applicable product safety and consumer protection requirements in the markets where they are sold.

Where required, products must satisfy relevant safety, labeling, traceability, and regulatory obligations.

Certain goods, including electrical devices, batteries, cosmetics, and wireless products, may be subject to additional rules.

We may remove or suspend products where safety, authenticity, intellectual property, or regulatory concerns arise.

Customers should follow all safety instructions and use products only for their intended purposes.

15. Promotions, Discounts, and Member Offers

SeeMyMailsMarketplace may offer discounts, special promotions, and exclusive benefits to registered members.

Promotions may be subject to eligibility criteria, start and end dates, product exclusions, and purchase limits.

Discounts are not automatically cumulative unless expressly stated.

We reserve the right to correct promotional errors or withdraw future offers for legitimate reasons, without affecting completed purchases or mandatory consumer rights.

16. Digital Products

Where digital goods, eBooks, downloadable content, or other digital products are offered, their specific delivery and usage terms will be stated on the relevant product page.

For EU consumers, the statutory withdrawal right for digital content not supplied on a tangible medium may be lost once performance begins only when the legally required conditions have been met, including any necessary prior express consent and acknowledgment.

Digital purchases remain subject to applicable conformity guarantees and other mandatory consumer rights.

17. Customer Accounts

Customers may be offered the option to create a Marketplace account.

Account holders are responsible for maintaining the confidentiality of their login credentials and providing accurate account information.

We may suspend accounts for legitimate security reasons, fraudulent activity, or serious violations of these Terms, subject to applicable law.

Customers may request account closure and exercise their data protection rights in accordance with our Privacy Policy.

18. Intellectual Property

The SeeMyMailsMarketplace name, original branding, website content, and other protected materials may not be reproduced or commercially exploited without appropriate authorization.

Supplier trademarks, brand names, and third-party materials remain the property of their respective owners.

Product listings do not imply sponsorship or endorsement by a trademark owner unless expressly stated.

19. Privacy and Personal Data

We process personal data for purposes including order management, payment processing, delivery, customer service, fraud prevention, and legal compliance.

Information may be shared with payment providers, logistics partners, suppliers, and technology providers where necessary and lawful.

Personal data is handled in accordance with applicable data protection laws, including the GDPR where relevant.

Customers should consult our Privacy Policy for further information about legal bases, retention periods, international transfers, and their rights.

Marketing communications requiring consent will be sent only where valid consent or another lawful basis exists.

20. Limitation of Liability

We are responsible for fulfilling our contractual and statutory obligations.

We are not responsible for losses caused exclusively by circumstances outside our legal responsibility, subject to applicable law.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, statutory product safety obligations, mandatory consumer guarantees, or any other liability that cannot legally be excluded.

21. Complaints and Consumer Mediation

Customers are encouraged to contact customer support first to seek an amicable resolution of disputes.

Where French consumer mediation rules apply, eligible consumers may refer unresolved disputes to a designated consumer mediator free of charge.

Consumer Mediator: [Designated mediation organization]
Website: [Mediator website]
Address: [Mediator contact details]

Customers may also seek assistance from competent consumer protection authorities or pursue other legally available remedies.

22. Governing Law and Disputes

These Terms are governed by the law of the country in which the confirmed selling entity is established, subject to mandatory consumer protection provisions.

Where French law applies, disputes will be handled in accordance with applicable French legal procedures.

Where consumers reside in another country, nothing in these Terms deprives them of mandatory protections or jurisdictional rights granted by applicable law.

Any separate business-to-business agreements may contain their own governing-law and dispute-resolution provisions.

23. Changes to These Terms

We may update these Terms to reflect changes in our business, legal requirements, or Marketplace operations.

Updated Terms will be published with a revised effective date.

Changes will not retroactively remove contractual or statutory rights relating to orders already concluded.

The version applicable to a purchase is generally the version in effect when the relevant sales contract was formed.

These Terms and Conditions of Sale are intended to be read together with the Marketplace's Privacy Policy, Shipping Policy, Refund and Return Policy, and Legal Notice.

Before publishing on Shopify

I preserved the important protections from the earlier SeeMyMails terms, including consumer refund rights, data privacy and restrictions on unfair liability exclusions.

The earlier SeeMyMails documents referenced a proposed US entity and Delaware business address, but that does not establish which company legally operates this French Shopify store. I have therefore not inserted an unverified corporate identity.

You still need to finalize the legal seller details, customer support address, shipping policy, actual supplier return arrangements and consumer mediator. For France, the customer-facing legal information should also be available in French.

You can add this text under Shopify Admin → Settings → Policies → Terms of Service. It is a working legal template, not a substitute for a jurisdiction-specific legal review.
